THE TERMS OF THIS PRIVACY & DATA USE POLICY (“POLICY”) ARE LEGALLY BINDING. IF YOU USE OUR SERVICES (AS DEFINED BELOW), YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS POLICY.
Datefit, LLC (“Datefit,” “we,” or “us”) respects the privacy of its users (“you”), and we developed this Policy to show you our commitment to protecting your privacy. This Policy is intended to disclose to you how we may collect, use and share your information. This Policy applies to you when you use any of Datefit’s services, whether using our website (http://datefit.com/), our mobile applications (“App”), or any other web-based or mobile service or offering of ours (collectively, our “Services”).

The Information We Collect
In General. We collect and store a number of different types of information from you when you use our Services, some of which is personally identifying, some not, and some of which you may consider sensitive. “Personal information” means information that may allow us to determine the actual identity of a user. Information you may consider sensitive (“sensitive data”) includes any information, content, or comments that you or other users voluntarily choose to provide. This type of information may often reveal your ethnicity, nationality, religion, and/or sexual preference. Our lawyers told us we have to warn you that by providing personal information or sensitive data to us, users (including you!) consent to our collection, use and disclosure of it.
We may collect any of the above information through various methods. For example, if you use our App, you grant us permission to collect, analyze, retain, and/or share information related to our operation or maintenance of the App. The information received through our Services may be sent to servers located in the United States and other countries around the world.
Information you provide. First, to sign up with Datefit, you’ll be asked to log in using your Facebook account or phone number. By joining our Services through Facebook, you authorize us to access your Facebook account information, including for example, your email address, birthday, likes, relationship status, photos, interests, personal description, friend list, gender, current city, education history, and public profile (consistent with your Facebook account’s privacy settings). Just to be clear, when you sign-up for our App using your Facebook account, you give us express permission to collect and store information about you. Some of this information could include your name, address, email address, telephone number, and financial information. You’re also granting us permission to gather information and photos of your Facebook friends who might be common Facebook friends with other Datefit users. If you link our Services with any other social networking service, then we may also collect certain information related to or associated with your account with that service. You may have the ability to control what information is shared from these third party social network services by adjusting the privacy settings on those services.
You’ll also be asked to let us collect information from your mobile device, which includes information about your location. When you use the App, information from your browser or device will be automatically collected. Examples of the type of information we collect include your browser type and language, IP address, type of device you use and its operating system, your device’s geographic location, and the times when you access the App. We may use different methods to gather data from your device and about your activities.
Last, if you chat with other users on the App, you grant to us the content of those chats. Also, if you contact us for any reason (e.g., because you really like chatting with customer support people), you grant to us the content of those communications.
Information from other sources. We may also sometimes obtain both personal and non-personal information about you from our business partners, contractors, and other third parties and may add it to our account or other information we collected about you.
Information collected automatically. We automatically receive information from the browser of the computer or mobile device from which you visit or use our Services. This information may include (without limitation) your IP address, your browser type and language, access times, the content of any undeleted cookies your browser previously accepted from us (see “Cookies” below), and the referring website address.
Information collected by third parties. We may allow our authorized service providers, advertising companies, and ad networks, to display advertisements on our Services and/or use tracking technologies to collect information about users who view or interact with their advertisements or use the Service. Our Services do not provide or grant access to any personally identifying information to these third-party advertisers. The tracking technologies allow the third parties to deliver targeted advertisements and gauge their effectiveness. Some of these third-party advertising companies may be interest-based advertising companies that may use cookies to collect non-personally identifiable information during your visit to the Service in order to help show advertisements on other websites likely to be more interesting to you. Information about others. We may also collect and store personal information about others that you provide to us when you use our Services. So, for example, if you use our Service to send other people a gift, information, invitations or correspondence, or other communications through our Services, we may store and use the information you provide. We use the information you provide about others in several ways, including (a) to allow people to respond to and comment on your invitation; (b) to send reminders and other event information; (c) to display your guests’ email address or other information to other guests of the same event; (d) to send post-event communications and promotional emails; (e) to provide certain services; and (f) to provide to third parties under some circumstances.
Cookies and similar technologies. When you visit our Services, we may assign the browser where you access our Services one or more cookies or similar technologies to facilitate access to our Services and personalize your online experience. Through the use of a cookie or similar technology, we also may automatically collect information about your online activity on our Services, such as the pages you visit, links you click and searches you conduct. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies or decide which types of cookies to automatically accept or reject. If you choose to decline cookies or other similar technologies, you may have difficulty signing in, and may not be able to use some of the interactive features offered through our Services.
Mobile devices. We may receive information from your mobile devices when you visit our Services, such as identifiers for advertising (“IDFA”) and geographic or geolocation information. If you choose to turn off identifiers such as IDFA or locational tracking on your mobile device, you may not be able to use some of the interactive features of our Services.
Other technologies. We may use other technologies, like web beacons, to track your use of our Services. We also may include web beacons in promotional or other email messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner helps us customize our Services, deliver targeted advertisements, and measure the overall effectiveness of our online advertising, content, programming or other activities.
What happens with the information we collect?
In general. We may use information that we collect about you to:
· Administer, distribute, or improve our products or the Services;
· Share information you voluntarily provided with other users;
· Manage your account and provide customer support;
· perform research and analysis about your use of, or interest in, our or others’ products, services or content;
· Communicate with you about products or services that may interest you from us, our business partners or other third parties;
· Develop and display content and advertising tailored to your interests;
· Verify your eligibility and deliver prizes in connection with contests and sweepstakes;
· Enforce our Terms of Service;
· Manage our business; and
· Perform other functions as described to you at the time of collection.
Financial information. If you provide us with financial or payment information to transact on our Services, we will use it to process payment for purchases made on our Services, to protect against or identify possible fraudulent transactions, and otherwise as needed to manage our business.
With whom do we share your information?
We want you to understand when and with whom we may share personal or other information you provided to us or that we collected about you or your activities on our Services. We may share information with:
Other users. Your Datefit profile will be viewable by other users, so some of your information will be shared with them. Other users may view information you provided to us directly or through Facebook, including for example, the approximate number of miles away and information you have in common with the person viewing your profile. If you chat with other users on the App, they will see the content of your chat.
Authorized service providers. We may share your personal information with our authorized service providers that perform services for us. These services may include fulfilling orders, making communications, processing payments, processing the redemption and accounting for Services, providing customer service and marketing assistance, performing business and sales analysis, supporting the functionality and data and technology infrastructure of our Services, and supporting contests, sweepstakes, surveys and other features offered through our Services. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use that information for any other purpose.
Business partners. We may share personal information with the businesses with which we partner. When you elect to engage in a particular merchant’s offer or program, you authorize us to provide your email address and other information to that merchant. We may also share information (including personal information) about you to third parties for targeted advertising, research, licensing and/or marketing purposes.
Aggregated and non-personal and hashed information. We may share information that has been “hashed”. (No, it’s not what you think! This is information that has been converted to an anonymized string of characters to prevent third parties from unscrambling the anonymized string of characters to recover the underlying information.) We may combine non-personal and/or hashed information we collect with additional information collected from other sources. We may combine non-personal and/or hashed information with other information collected about a user and share it with third parties for their or their partners’ advertising and/or marketing purposes. We also may share aggregated and/or non-personal and/or hashed information with third parties, including (without limitation) advisers, advertisers and investors.
Other situations. We also may disclose your information:
· In response to a subpoena or similar investigative demand, court order, or request for cooperation from a law enforcement or other government agency; when we believe disclosure is appropriate to help investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, users, employees, or others; to enforce our Terms of Use or other agreements or policies; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.
· In connection with a corporate transaction (for example, if we get bought or merge with another company). We don’t share your personal information with others except as indicated herein or when we inform you and give you an opportunity to opt out of having your personal information shared.
Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Policy. Please note that these entities or their servers may be located inside or outside the United States.
Aggregated and/or non-personal information. This information doesn’t in itself identify any specific users, and we may use or share it in any of the above circumstances. We may incorporate the information we collect with information from other sources, and share any aggregated information with various third parties for conducting analysis, marketing, or other business purposes. To opt out of the sharing of your geolocation or other personal information, please contact us or discontinue use of the App.
Do Not Track disclosure
Under California law, online service providers must disclose their process for Do Not Track (“DNT”) signals. DNT is a mechanism that users can employ to inform online services that they do not want certain personal information collected over time and across websites or online services. We don’t recognize or respond to any DNT signals. Instead, we have provided you the opt-out options so you may exercise your own choices regarding the collection of your personal information.
Third-party websites
Through our Services, you may be given opportunities to access other third-party websites that don’t operate under this Policy. For example, if you click on an advertisement in our Services, you may be taken to a website that we don’t control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some cases, provide us with information about your activities on those websites. We’re not responsible for the practices of these third parties, and we recommend that you consult the privacy statements of all third-party websites you visit to review how they use information collected from you.
How can you access and correct your information?
You may review and update your personal information in the App’s settings, or by contacting customer support at Support@Datefit.com.
In certain exceptional circumstances, we may not be able to provide access to certain personal information we hold. For security purposes, not all personal information is accessible and correctable by customer support. If access or corrections can’t be provided, we’ll notify you of the reasons why.
You also may choose to close your account at any time by using the App’s settings, or by submitting a request to customer support at: support@datefit.com. After you close your account, you will not be able to sign in to our Services or access any of your personal information. However, you can open a new account at any time. Please note that if you close your account, we may still retain, use and disclose information associated with your account.
Data retention
We use your information for legitimate business purposes. For that purpose, we keep your information only as long as we need it and as permitted by applicable laws. If you delete your account, we keep certain data for recordkeeping, analysis, enforcing our Terms of Use, fraud prevention, or protecting our company, the App, and its users. If any of your information was provided to third parties before deleting your account, retention of that information will be subject to those third parties’ policies.
What choices do you have about collection and use of your information?
You may choose to not provide us with certain information, but this may prevent you from using certain features of the App.
You can enable or disable notifications from our App on your mobile device by changing the settings in the App or the settings on your mobile device.
Most browsers allow you to control information collected by cookies. Check your browser settings to delete or decline cookies.
How do we protect your personal information?
We take reasonable security measures (including physical, electronic and procedural measures) intended to help safeguard your personal information from unauthorized access and disclosure. For example, we use firewalls to help prevent unauthorized persons from gaining access to your personal information.
We want you to feel confident using our Services. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure. Please be advised that whenever you voluntarily disclose personal information on publicly-viewable sources, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We can’t always control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Once you have posted information, you may not be able to edit or delete such information.
You should be careful how you handle and disclose your personal information. The Federal Trade Commission's website (http://www.ftc.gov/bcp/menus/consumer/data.shtm) has information about how to protect yourself against identity theft.
You agree that we may communicate with you electronically regarding security, privacy, and administrative issues, like security breaches. We may post a notice if a security breach occurs, and/or we may send an email to the email address you provided us. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us via customer support at the address below.
Information you provide about yourself while using our Service
We provide areas on our Service where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Use. Also, whenever you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. Sorry if we sound repetitive, but again, we can’t control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Except as required by a court order or other similar legal proceeding, we will only make messages you send to another user through our Service accessible on the Service, unless you expressly request a copy of your messages in accordance with applicable law. Should you wish to receive a copy of any messages you received from other users through our Service, you must first obtain their prior written consent and then they must contact our Privacy Officer to provide their prior written consent.
Children's privacy
Our Services are for a general audience and are not directed to or intended for children under the age of 18. Accordingly, we do not knowingly collect personal information from children under the age of 18 and if we become aware that we have, we will promptly delete such information from our servers.
Visiting our websites from outside the U.S.
If you access our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. This Policy and the storage, use and disclosure of your information under this Policy, is governed by the laws of the United States. The Services are controlled and operated by Datefit from the United States and you expressly waive the application of any laws of any country or territory other than the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using our Services, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy, and the laws of the United States apply to the use, storage and disclosure of your information.
No Rights of Third Parties
This Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to our users.
Changes to this Policy
We reserve the right to amend this Policy at our sole discretion. When we revise this Policy, we’ll notify you by posting the new Policy on the Services with the “Last Updated” legend at the top and any modifications will be effective immediately upon posting. You should check for updates to this policy regularly. By continuing to use the Services following any changes, you’ll be deemed to have consented to and agreed to those changes. If you don’t agree with the terms of this Policy or any changes, you may discontinue using the Services.
